TERMS & CONDITIONS

INTRODUCTION

Welcome to EIR BRUNETTE. By accessing eirbrunette.com, viewing content, or acquiring any object through the platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions. All works released under EIR BRUNETTE are original one-of-one objects. No mass production, duplication, reproduction, or open-edition manufacturing exists unless explicitly stated otherwise in writing. Each acquisition represents ownership of a singular physical object only and does not include any transfer of intellectual property rights, reproduction rights, licensing rights, or commercial usage rights. These Terms apply to all art, garments, furniture objects, sculptural works, functional artworks, commissioned pieces, private releases, digital content, and future exhibitions, installations, collaborations, or releases associated with EIR BRUNETTE. Continued use of the Site constitutes acceptance of any revisions, modifications, or updates made to these Terms at any time.

ELIGIBILITY

By placing an order or attempting to acquire any work through the Site, you confirm that you are at least eighteen years old or the legal age of majority within your jurisdiction, legally capable of entering binding agreements, and legally permitted to purchase, receive, import, and own the object being acquired. All information submitted during checkout, inquiry, or communication must be accurate, current, and complete. EIR BRUNETTE reserves the unrestricted right to refuse, cancel, limit, suspend, or revoke access to any order, transaction, inquiry, or collector relationship at any time and for any reason, including but not limited to suspected fraud, payment irregularities, resale concerns, abusive conduct, or collector verification issues.

ORDERS & ACCEPTANCE

All orders submitted through the Site constitute a binding request to acquire a one-of-one object. An order is not considered accepted until payment authorization has been completed, availability of the exact object has been confirmed, and final approval has been issued by EIR BRUNETTE. Because all objects are singular in existence, availability is strictly limited to the specific work displayed or allocated at the time of release. EIR BRUNETTE retains complete discretion over release timing, collector access, order approval, allocation structure, and purchase eligibility. Orders may be refused or canceled at any stage prior to dispatch without obligation or liability. Once an order has been formally accepted, all sales become final and irreversible. No cancellations, modifications, reversals, exchanges, refunds, or substitutions will be permitted after confirmation.

ONE-OF-ONE POLICY

Every object released by EIR BRUNETTE exists as a structurally one-of-one work. This includes garments, furniture objects, sculptural works, functional pieces, hybrid constructions, and commissioned releases. No reproductions, reruns, duplicates, reproductions, or restocks are produced. Each object exists independently with its own provenance, archival registration, fabrication history, and release record. Scarcity is permanent and integral to the identity of the work itself rather than a temporary marketing structure. EIR BRUNETTE reserves full control over all release timing, production decisions, archival records, future exhibitions, and allocation access.

PRICING

All pricing is listed in United States Dollars unless otherwise stated. Pricing reflects a combination of material composition, fabrication complexity, scale, construction methods, conceptual value, provenance, artistic authorship, release rarity, and structural uniqueness. Prices remain subject to change without notice. In the event of pricing inaccuracies, technical malfunctions, payment errors, or system failures, EIR BRUNETTE reserves the right to correct, refuse, or cancel any affected transaction regardless of order status. Collectors remain solely responsible for currency conversion charges, banking fees, payment processing costs, customs duties, import taxes, VAT obligations, and any additional governmental or financial charges associated with acquisition or international delivery. Shipping costs are separate unless otherwise stated in writing.

PAYMENT

Accepted payment methods may include major credit cards, debit cards, PayPal, bank wire transfer, and approved private payment arrangements. Full payment must clear prior to release, dispatch, transfer, or delivery of any object. High-value acquisitions may require additional identity verification, fraud screening, payment confirmation, or manual approval prior to acceptance. Transactions identified as high-risk or suspicious may be delayed, suspended, refused, or reversed without notice. No object will be released under any circumstance prior to complete payment settlement and verification.

PAYMENT SECURITY

All transactions are processed through encrypted SSL-secured systems and verified payment gateways designed to protect financial information and reduce fraudulent activity. Security procedures may include address verification, manual transaction review, fraud screening systems, and identity confirmation for high-value acquisitions. Full payment details are never stored directly by EIR BRUNETTE. All collector information is treated as confidential operational data and used strictly for transaction processing, fulfillment, security, communication, and delivery coordination.

INTELLECTUAL PROPERTY

All intellectual property associated with EIR BRUNETTE remains exclusively owned by EIR BRUNETTE. This includes but is not limited to garment designs, furniture constructions, artwork concepts, object fabrication methods, branding, logos, graphics, photography, campaign imagery, digital content, written materials, product imagery, packaging systems, and website design. Acquisition of a physical object does not transfer copyright ownership, trademark rights, licensing rights, reproduction rights, distribution rights, or commercial usage rights. Ownership remains strictly limited to the physical object itself unless otherwise stated in writing. Unauthorized reproduction, counterfeit production, archival duplication, derivative works, AI training usage, image exploitation, commercial publication, or unauthorized resale of imagery is strictly prohibited.

AUTHENTICITY & PROVENANCE

Each one-of-one object may be accompanied by a Certificate of Authenticity or equivalent provenance documentation. Documentation may include the title of the work, dimensions, materials, fabrication details, classification, creation date, and verification information. EIR BRUNETTE maintains private provenance records and archival documentation for all released works in order to preserve authenticity, ownership verification, and release history. Loss, transfer, or destruction of physical documentation does not invalidate internal archival records maintained by EIR BRUNETTE.

COLLECTOR RELATIONSHIP

Acquisition of a work does not establish partnership, representation, membership, employment, agency, or any ongoing contractual relationship beyond the completed transaction. Communication regarding future releases, private access, collector previews, allocations, installations, commissions, or exhibitions remains entirely discretionary and may be limited, restricted, or revoked at any time. Ownership rights remain strictly limited to the acquired physical object and do not extend to any associated intellectual property or future release access.

LIMITATION OF LIABILITY

Liability is strictly limited to the original purchase amount paid for the object. EIR BRUNETTE shall not be held liable for indirect damages, consequential damages, customs delays, customs seizures, import restrictions, carrier mishandling, delayed delivery, environmental exposure, improper storage, unauthorized restoration attempts, resale disputes, lost profits, or events outside reasonable operational control. Risk transfers fully to the collector upon carrier acceptance, dispatch confirmation, or confirmed delivery. Collectors assume full responsibility for proper handling, storage, insurance, preservation, and maintenance after transfer.

FORCE MAJEURE

EIR BRUNETTE shall not be responsible for delays, interruptions, failures, or inability to perform obligations caused by events beyond reasonable operational control, including natural disasters, government restrictions, labor disputes, supply chain failures, transportation disruptions, cyberattacks, pandemics, civil unrest, war, or global emergencies. Operational timelines, releases, production schedules, dispatch dates, and fulfillment obligations may be delayed, suspended, modified, or canceled accordingly without liability.

SHIPPING & DELIVERY

PROCESSING & FULFILLMENT

In-stock objects generally require approximately seven to fourteen business days for preparation and dispatch. Furniture works, large-scale objects, and commissioned pieces may require extended preparation timelines depending on fabrication complexity, packaging requirements, insurance approval, export procedures, or logistical coordination. Any timeline communicated through the Site, email, or private communication remains an estimate only and does not constitute a guaranteed delivery commitment.

PACKAGING & PRESENTATION

Every object is prepared using material-specific protection methods intended to preserve the integrity of the work during transit. Packaging standards may include archival wrapping, reinforced protection systems, moisture barriers, custom crating, foam structuring, discreet exterior packaging, and museum-grade handling procedures depending on the scale and material composition of the object. Presentation forms part of the acquisition experience and may vary according to object classification, release structure, or shipping requirements.

SHIPPING METHODS

Shipments may be fulfilled through premium international carriers including DHL, UPS, FedEx, specialized freight services, white-glove logistics providers, or fine art transportation partners. All shipments include insurance coverage, tracking information, and signature confirmation unless otherwise determined by EIR BRUNETTE. Carrier selection remains entirely at the discretion of EIR BRUNETTE based on object classification, destination, insurance requirements, and logistical considerations.

INTERNATIONAL SHIPPING & CUSTOMS

International collectors remain fully responsible for customs duties, import taxes, VAT obligations, brokerage fees, local governmental charges, and clearance procedures associated with delivery into their jurisdiction. Customs delays, inspections, seizures, or refusals remain outside operational control and do not qualify for refunds, reversals, or cancellations. Refused imports, abandoned shipments, or undeliverable packages may result in additional charges, storage fees, or permanent forfeiture depending on carrier and customs policies.

DELIVERY ESTIMATES

Estimated transit times vary depending on destination, carrier conditions, customs processing, and logistical disruptions. Domestic United States shipments generally arrive within five to ten business days after dispatch. European deliveries generally require seven to fourteen business days. United Kingdom deliveries generally require seven to twelve business days. Deliveries to Japan, South Korea, and Hong Kong generally require ten to eighteen business days. China, South America, and certain international destinations may require significantly longer transit periods. All delivery windows remain estimates only and are not guaranteed under any circumstance.

RETURNS & REFUNDS

Due to the nature of one-of-one works, all sales are final. Returns, exchanges, refunds, reversals, and chargebacks are not accepted except where legally required under applicable consumer protection law. Minor irregularities, distressing, tonal inconsistencies, fabrication marks, surface variation, aging characteristics, hand-finished details, and material imperfections are considered intentional characteristics of the work itself and shall not be classified as defects.
